Terms and Conditions

1. The Service

QejaCrib provides a mobile workspace for landlords and authorised team members to manage properties and units, review applications, handle maintenance, message tenants, record rent payments, and receive notifications. Staff administration, reports, and some financial tools remain available on the web landlord portal.

Tenants use a separate QejaCrib tenant app. QejaCrib is a technology platform only and is not a party to leases between you and your tenants unless expressly agreed in writing.

2. Eligibility and your account

• You must be at least 18 years old and able to enter a binding contract.
• Provide accurate, current information and keep it updated.
• You are responsible for safeguarding your login credentials and for activity under your account, including actions by team members you authorise.
• We may suspend or terminate access if you violate these Terms, pose a security risk, or if required by law.

3. Portfolio, tenants and payments

You are responsible for the accuracy of property, unit, rent, and tenant records you manage. Lease terms, deposits, and payment rules are between you and your tenants. Platform subscription billing uses M-Pesa (Paystack) on Android and the web portal. The iOS app does not sell subscriptions; you may start a free trial in the app. Tenant rent you record in the app is not an App Store purchase.

• Approving applications may create or update tenant and lease records linked to your portfolio.
• Disputes about rent, deposits, or lease terms must be resolved between you and your tenants.
• QejaCrib does not hold tenant security deposits unless expressly stated in writing.

4. Acceptable use

You agree not to use the Service unlawfully or fraudulently; harass, threaten, or impersonate another person; upload false, misleading, or infringing content; access accounts or systems without authorisation; interfere with or reverse-engineer the Service except where law permits; or scrape, resell, or commercially exploit the Service without written consent.

5. Your content

You retain ownership of content you submit, such as property details, photos, notes, and messages. You grant QejaCrib a non-exclusive, worldwide licence to host, store, display, and transmit that content solely to operate the Service and share it with tenants and service providers as needed.

6. User-generated content and safety

QejaCrib has zero tolerance for objectionable content or abusive users. Messages and other user content must not include harassment, hate speech, threats, sexual content involving minors, spam, scams, or illegal material. Use in-app reporting tools where available. We aim to review reports within 24 hours and may remove content or suspend accounts that violate these Terms.

7. Third-party services

The Service integrates with third parties, including authentication providers, mapping services, cloud storage, and payment processors on the web portal. Their terms may apply. We are not responsible for third-party outages, fees, or actions outside our reasonable control.

8. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, QejaCrib disclaims warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted operation or that every portfolio action will succeed without network or third-party delays.

9. Limitation of liability

To the maximum extent permitted by law, QejaCrib and its affiliates, directors, and suppliers shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for a claim relating to the Service shall not exceed the greater of fees you paid to QejaCrib in the twelve months before the claim or KES 5,000 if you paid no fees. Where law does not allow these limits, liability is limited to the maximum permitted.

Our Privacy Policy explains how we collect, use, and protect personal data.

11. Changes and termination

We may modify the Service or discontinue features. Updated Terms will be posted here and in the app where practicable. You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or where required for security or legal compliance.

12. Governing law

These Terms are governed by the laws of the Republic of Kenya. Courts in Kenya have exclusive jurisdiction, subject to mandatory protections that may apply to you.
